Terms of Service

1. Acceptance of Terms

By creating an account or using Comerch, you agree to these Terms of Service. If you are using the platform on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Service Description

Comerch is a SaaS platform for garment buying house management. It provides order lifecycle management, email syncing and intelligence, production tracking, quality control tools, alert systems, and related features. The service is provided "as is" and we continuously improve and update features.

3. User Accounts

You are responsible for maintaining the security of your account credentials. Each user must have their own account. Sharing credentials is not permitted. You must notify us immediately of any unauthorised access to your account.

4. Data Ownership

You retain full ownership of all data you upload or create in Comerch. We do not claim any intellectual property rights over your content. We store and process your data solely to provide the service as described.

5. Third-Party Integrations

Comerch integrates with third-party services such as Google Gmail. When you connect a third-party account, you authorise Comerch to access data from that service as described in our Privacy Policy. You can revoke third-party access at any time from your settings. We are not responsible for the availability or terms of third-party services.

6. Acceptable Use

You agree not to misuse the platform. This includes but is not limited to: attempting to access other users' data, reverse-engineering the platform, using the platform for illegal purposes, or uploading malicious content. We reserve the right to suspend accounts that violate these terms.

7. Billing & Payment

Paid plans are billed monthly or annually as selected. Prices are in Indian Rupees (INR) and are exclusive of applicable taxes. You can cancel your subscription at any time from the Settings → Billing page in your account — your Pro features will remain active until the end of your current billing period. No questions asked. Refunds are handled on a case-by-case basis — contact us at support@comerch.co for refund requests.

8. Service Availability

We aim to keep the service available at all times but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors outside our control, including third-party service outages (e.g. Gmail API, payment gateways) or internet connectivity issues.

9. Limitation of Liability

Comerch is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

10. Account Termination

You may delete your account at any time. Upon deletion, all your data will be permanently removed within 30 days as described in our Privacy Policy. We may suspend or terminate accounts that violate these terms, with notice where practicable.

11. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of India. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
